NicClear is a mobile application ("App", "The App") provided by Home Cook Technologies Ltd ("us," "we," or "our"). These Terms of Use ("Terms") govern your access to and use of NicClear. By accessing or using the App, you agree to be bound by these Terms and all applicable laws and regulations.

Apple End User License Agreement (EULA)

By using the NicClear application (“App”), you also agree to abide by the Apple End User License Agreement (EULA), which governs the use of apps downloaded from the App Store. The Apple EULA sets out additional terms and conditions that apply to your use of the App, including but not limited to rights and restrictions on its use.

In the event of any conflict between this Terms of Use and the Apple EULA, the terms of the Apple EULA will take precedence to the extent of such conflict.

User Inputs and Responsibilities

The App requires you to provide specific information to create a nicotine reduction plan tailored to your needs. This includes:

  • The type of nicotine product you use,

  • Your daily nicotine usage,

  • Weekly spending on nicotine products,

  • Your wake-up and sleep schedule,

  • Your motivation for quitting, and

  • Your readiness to quit.

It is your responsibility to provide accurate and up-to-date information. Inaccurate data may result in suboptimal plans or estimates.

Nicotine Reduction Plans and Metrics

The nicotine reduction plans and metrics provided by the App are intended as tools to assist your quitting journey.

  • No Guarantees: We do not guarantee that the App will help you quit using nicotine.

  • Estimated Metrics: Calculations such as "money saved" are based on user inputs and are provided as estimates. These may vary depending on regional factors, currency differences, and individual circumstances.

Health Disclaimers

NicClear is not a substitute for professional medical advice, diagnosis, or treatment. You should consult a healthcare professional before beginning any nicotine reduction or quitting plan.

Reducing or quitting nicotine use may lead to withdrawal symptoms, such as cravings, irritability, or physical discomfort. These risks are inherent to the quitting process and are outside the App’s functionality.

Content

The App provides tools and information to support your quitting journey. We make no guarantees regarding the accuracy, completeness, or effectiveness of any plans or metrics provided.

Third-Party Services

We use third-party services, including:

  • Firebase by Google: For data collection, monitoring, and analytics.

  • TelemetryDeck: For anonymized usage data analysis.

These services operate under their respective privacy policies. By using the App, you agree to their terms and conditions.

Payments and Subscriptions

  • Lifetime Access: Your purchase of NicClear grants you lifetime access to the App’s features.

  • Future Subscriptions: We reserve the right to introduce subscription-based plans in the future, subject to additional terms.

  • Refunds: All payments are handled by Apple’s In-App Purchase system. Refund requests must be made directly through Apple.

Updates and Modifications

We reserve the right to modify or update the App and these Terms at any time without prior notice. You are encouraged to review these Terms periodically for any changes. Your continued use of the App following the posting of any changes to these Terms constitutes acceptance of those changes.

Termination and Suspension

We reserve the right to terminate or suspend your access to the App without notice if:

  • You violate these Terms,

  • You misuse the App, or

  • You engage in behavior harmful to other users or the App’s operation.

Disclaimers

The App and its contents are provided on an "as is" and "as available" basis. We do not guarantee the accuracy, completeness, or usefulness of any information provided within the App. You agree that the use of the App is at your sole risk. We expressly disclaim all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

In no event shall we, our affiliates, or our service providers be liable for any direct, indirect, punitive, incidental, special, or consequential damages arising out of or in any way connected with your use of the App, whether based on contract, tort, warranty, or any other legal theory, even if advised of the possibility of such damages.
